for booking accommodations with MINT Apartments

§ 1 Scope
(1) These General Terms and Conditions (hereinafter 'GTC') apply to all contracts for the rental of furnished apartments and accommodations (hereinafter 'Accommodation') by MINT Apts. – Timo Schalow, Blumenthalstr. 4, 10783 Berlin (hereinafter 'Landlord') to the guest or booker (hereinafter 'Guest').
(2) These GTC apply to both short-term rentals (under 6 months) and worker accommodations. Additional agreements apply for temporary living from 6 months.
(3) Deviating conditions of the Guest are not recognized unless the Landlord expressly agrees to their validity in writing.
§ 2 Contract Conclusion and Booking
(1) The presentation of accommodations on our website does not constitute a binding offer, but an invitation to submit a booking offer.
(2) By completing the booking process and payment via our payment service provider (Stripe), the Guest submits a binding booking offer. The contract is concluded with the booking confirmation by email.
(3) The Guest is obliged to provide truthful and complete information when making a booking.
§ 3 Prices and Payment
(1) The prices stated on the website at the time of booking apply. For private bookings, all prices are final prices including the statutory value added tax. For worker accommodations, prices are displayed as net prices plus 7% VAT.
(2) Payment is made at the time of booking via the payment service provider Stripe. The full amount is due at the time of booking.
(3) For worker accommodations, the price is calculated per sleeping spot per night. The total price results from the number of workers, the price per sleeping spot and the length of stay.
§ 4 Check-in and Check-out
(1) Check-in is available from 3:00 PM on the day of arrival. Check-out must be completed by 10:00 AM (Berlin) or 11:00 AM (Dortmund) on the day of departure.
(2) Access to the accommodation is provided via a digital access code that is communicated to the Guest by email before check-in. No personal key handover takes place.
(3) For late check-out, a fee of €25 per started hour will be charged. From 2:00 PM, an additional overnight stay at the full daily rate will be charged.
§ 4a Security Deposit
(1) To protect against damage to the accommodation, the Guest's credit card is stored for a security deposit at the time of booking. The deposit amount is generally €250, unless otherwise stated at the time of booking.
(2) The deposit is held (authorized) on the stored credit card 48 hours before check-in. For stays up to 5 days, the amount is only held (not charged). For longer stays, the deposit is charged and refunded after the stay.
(3) The deposit is released or refunded after check-out and a damage inspection within 7 business days. In case of identified damage, the corresponding amount up to the deposit will be retained. If the damage exceeds the deposit, the Landlord reserves the right to further claims.
(4) No separate deposit is charged for bookings via third-party platforms (e.g. Airbnb, Booking.com), as these platforms provide their own protection mechanisms.
§ 4b Digital Check-in and Registration Obligation
(1) Check-in is conducted digitally via the Staymint Guest Portal. The Guest receives a personal check-in link by email before the stay.
(2) Foreign guests are required under §§ 29, 30 of the German Federal Registration Act (BMG) to provide additional information during check-in (home address, date of birth, accompanying persons) and to identify themselves with a valid ID document.
(3) For direct bookings via our website, digital ID verification via the Stripe Identity service is required for all guests. The verification serves identity verification and fraud prevention purposes.
(4) The Guest is obliged to provide truthful information. False information entitles the Landlord to terminate the accommodation contract without notice.
§ 5 Cancellation
(1) The Guest may cancel the booking under the following conditions:
- •Up to 14 days before arrival: Free cancellation, full refund.
- •7 to 13 days before arrival: 50% of the total price will be refunded.
- •Less than 7 days before arrival: No refund.
(2) Cancellations must be submitted in writing by email to the address stated in the Legal Notice. The relevant time is the receipt of the cancellation.
(3) The Landlord reserves the right to cancel the booking in case of force majeure or unforeseen circumstances (e.g. significant damage to the accommodation). In this case, the full booking amount will be refunded.
§ 6 Obligations of the Guest
(1) The Guest is obliged to treat the accommodation with care and return it in the condition in which they found it (less normal wear and tear).
(2) Smoking is strictly prohibited in the accommodation. A cleaning fee of €250 will be charged for violations.
(3) Parties, events and excessive noise are not permitted. Quiet hours from 10:00 PM to 7:00 AM must be observed.
(4) The accommodation may only be used by the number of persons specified at the time of booking. Subletting is not permitted.
(5) Damage to the accommodation or its furnishings must be reported to the Landlord immediately.
§ 7 Liability
(1) The Landlord is liable for damages based on intentional or grossly negligent breach of duty. In the case of simple negligence, the Landlord is only liable for breach of essential contractual obligations and only up to the amount of foreseeable, contract-typical damage.
(2) Liability for damages resulting from injury to life, body or health remains unaffected.
(3) The Guest is liable for all damages to the accommodation, its furnishings or the building caused by them or their fellow travelers.
§ 8 Special Provisions for Worker Accommodations
(1) For worker accommodations, the allocation of sleeping spots to available apartments is made by the Landlord. The Landlord reserves the right to make the allocation at their own discretion.
(2) The booking company is responsible for compliance with the house rules by all accommodated workers.
(3) Multiple apartments may be allocated for a group. The composition of apartments may vary depending on availability.
§ 9 Right of Withdrawal
According to § 312g (2) No. 9 BGB, there is no right of withdrawal for contracts for the provision of services in connection with accommodation (for purposes other than residential purposes) if the contract provides for a specific date of performance. Since our bookings include a fixed arrival date, the right of withdrawal is excluded. The cancellation conditions according to § 5 of these GTC apply.
§ 10 Final Provisions
(1) The law of the Federal Republic of Germany applies.
(2) If the Guest is a merchant, legal entity under public law or a special fund under public law, the place of jurisdiction for all disputes is Berlin.
(3) Should individual provisions of these GTC be or become invalid, this shall not affect the validity of the remaining provisions.
(4) The contract language is German.
